The Bush Administration, did everything they could to restrict the definition of "torture" as only applying to the most extreme forms of torture, and then basically said that anything short of that was acceptable as "enhanced interrogation techniques." If CIA or military personnel clearly engaged in what even the Bush Justice Department agreed was torture, then there is a case for prosecution.
